Right on Shannon! Even though my other posts were taken in away I could not convey, this is what I'm talking about with this County. It dosn't matter if you are right, you stand up to them, they will get you and use everything you can imagine to do so. Those of us that have faught them before Jana, hope and pray with every individual fight that maybe this time they hang themselves. Then we wait every election year.....maybe this time.....maybe this time!

I really just don't see how anyone in their right mind cannot say the Commissioner's Court and County Judge Gattis are not being vindictive by filing this grievance with the State Bar of Texas. As previously stated, the Commissioners will not discuss any specific information on the allegation. However, the Round Rock Leader refers back to the letter sent to Gattis in May of 2008 regarding attorney-client confidentiality and the Court's problems with Assistant County Attorney Stephen Ackley (now deceased). Seriously, if this is not about something recent and if this is not directly about Jana Duty, drop it. But why not file a complaint with the State Bar about Mike Davis (who illegally billed the county) or Don Higginbotham because of the alleged sexual harassment? Why all that drama at Tuesday's meeting? The voters see right through your act. Commissioners - you are only hanging your own political careers now. If you claim that you only want to get on with county business then why file the complaint with the State Bar? Do you realize how pathetic this makes you look? It's just pathetic. Goodbye Birkman. Goodbye Covey. It will be a long wait until November 2012 but I would bet against both of you no matter who your opponents are - in a heartbeat. Birkman don't even think about coming back to the BCMUD when you are finished with the county. You've done enough damage here already.

And so it begins.....from the Williamson County Sun.... Commissioners court to file grievance against Duty: The Williamson County Commissioners Court chose to file a grievance with the State Bar of Texas on Tuesday, accusing County Attorney Jana Duty of professional misconduct. Several of the commissioners expressed reluctance to approve the grievance, which accuses Ms. Duty of violating eight different ethics codes, including attorney-client confidentiality , competent representation, conflict of interest and truthfulness with others. But all five commissioners voted for the motion, including Commissioner Lisa Birkman, who postponed the decision last week after stating her hesitation to request disciplinary action against a former neighbor and friend.

In her motion to dismiss this case, Dickie cited a decision referenced in RE: Bazan, 251 S.W. 3d 39, 44 (Tex. 2008) concerning the re-election of a county official, and examines ‘the forgiveness doctrine.’ The judgment in Bazan states “Texas law should not reward officials for being adept at hiding their criminality until after the election passes, and while some other states’ laws expressly limit removal to misconduct committed during the same term, Texas law, in my view, does not require that removal be confined to present-term acts. The expiration of a term in no way prevents prosecution under the criminal law;  nor should it prevent ouster under the removal law.” The judgment concludes “Elections may forgive a multitude of sins, but in Texas, once you swear your first oath of office, staying in office means staying felony-free.” Gattis is no king, nor is a CEO. He deserves a criminal conviction. Gattis is a crook, and the voters know better. I stand behind Jana Duty!

@JT...it's too late for my family's career at Wilco, but I so hope you are right. I've seen way too much corruption be sweeped under the rug and too many fine people fall at the hands of this group. There are always going to be loop holes. But once again, I hope you are right. I want you to be right! I fear the court's next step will be NOT to drop this but continue their obvious retaliation towards Duty with proceeding with getting her disbarred. If this happens and I pray that it does not, they will then appoint a "family" member to take over until election time. It's an ugly cycle.

I disagree EOW. Everyone I talk to likes Duty keeping them in check. Since yesterday, after a lot of my friends and neighbors found out how Gattis got off, they are even more mad and support her. Even the neighbors I have that supported Gattis are disgusted at him and support Duty. I'm sure they'll line up their cronies to run against her but who cares. Anyone tied to Gattis is a good ole boy.

@ JT...I'm not putting her down. She was trying to do what needed to be done, get rid of the corrupt elected officials. Now they are going to get rid of her because of what she attempted to do. I know exactly how they work as I have seen it numerous times with these officials. Do a google.....

Duty actually had a solid case against Gattis from the legal pleadings she filed. They are listed in a few stories down the page. There was plenty of hard evidence to have him removed and he knew it. That is why he went this route. He knew if it went to trial his goose was cooked. But, he found a loop hole in the law with the "forgiveness doctrine". That's the way it goes. Keep up the good work Duty. With this guys track record, you'll have another shot before you know it.
