Lawsuit to Remove County Judge Gattis Dismissed

Judge Morris’ Opinion States Considered
All Filings But Provides No Rationale

Rick MorrisRick MorrisJudge Rick Morris of the 146th Judicial District Court of Bell County today issued an order that dismissed the civil lawsuit filed December 22 by Williamson County Attorney Jana Duty to remove County Judge Dan A. Gattis for alleged incompetence and official misconduct.

The Order of Dismissal states the lawsuit “is dismissed with prejudice,” meaning the plaintiff is barred from bringing an action on the same claim.

The order was filed in the office of Williamson County District Clerk Lisa David today at 1:48pm.

Jana DutyJana DutyCounty Attorney Duty issued a press release stating “the law does not require that any reason be given for the dismissal and none was given in this case. As there is no right of appeal, I consider this case closed.

“I want to assure the citizens of Williamson County that I will continue to be vigilant in fulfilling the duties of the Office of County Attorney and do my best to ensure the interests of the citizens of Williamson County are protected.”

Dan GattisDan GattisConnie Watson, public information officer for Williamson County, said that Judge Gattis is out of the office and no statement would be issued today.

Judge Morris’ office stated that the Code of Judicial Conduct prevents him from commenting on this case.

Gattis’ attorney Martha Dickie did not immediately return a call asking for comment.

A related report was published January 17 concerning the Williamson County Commissioners Court’s agenda item to file a grievance against Duty with the State Bar of Texas. That item is now on the agenda for next Tuesday, January 25.

The Williamson County Public Policy Coalition yesterday sent a letter to request that Judge Gattis and Precinct 4 Commissioner Ron Morrison recuse themselves from considering the filing of a grievance due to a conflict of interest. Morrison was named in one of the allegations in the removal lawsuit.

Updated 5:03pm: County Attorney Duty just issued a revised press release to clarify that Texas Local Government Code Section 87.001 is cited in the dismissal order, which states, “An officer may not be removed under this chapter for an act the officer committed before election to office.” This is the “forgiveness doctrine” that was explained at length in The Austin Bulldog’s previous reports on this lawsuit.

He got away with it (again). Go figure! At least the public knows his true character.He name calls, and hides behind his good ole boys. I am very proud of the Williamson County Attorney for not “being one of them” …. that just looks the other way. Please keep on top of all of the elected officals shady deals Jana Duty. We want you around for 12 more years and then some… Gattis and friends can not be trusted.

Nice to know our elected officials can commit illegal acts and if they conceal them before they are reelected, there's not a thing that can be done. Dan Gattis Sr. got off on a technicality. What a disgrace to our legal system and a slap in the face to Williamson County.
Thank you Mrs. Duty for standing up to the good ole boys. We need more like you in office! Please don't let this discourage you and keep up the good fight!

I am outraged! I am appalled! I am disgusted! I am NOT surprised! A good ole boy loop hole law for a good ole boy!
Dan Gattis is a disgrace to Williamson County. I also applaud you Jana for your courage and dedication.

Duty actually had a solid case against Gattis from the legal pleadings she filed. They are listed in a few stories down the page. There was plenty of hard evidence to have him removed and he knew it. That is why he went this route. He knew if it went to trial his goose was cooked. But, he found a loop hole in the law with the "forgiveness doctrine". That's the way it goes. Keep up the good work Duty. With this guys track record, you'll have another shot before you know it.

@ JT...I'm not putting her down. She was trying to do what needed to be done, get rid of the corrupt elected officials. Now they are going to get rid of her because of what she attempted to do. I know exactly how they work as I have seen it numerous times with these officials. Do a google.....

I disagree EOW. Everyone I talk to likes Duty keeping them in check. Since yesterday, after a lot of my friends and neighbors found out how Gattis got off, they are even more mad and support her. Even the neighbors I have that supported Gattis are disgusted at him and support Duty. I'm sure they'll line up their cronies to run against her but who cares. Anyone tied to Gattis is a good ole boy.

@JT...it's too late for my family's career at Wilco, but I so hope you are right. I've seen way too much corruption be sweeped under the rug and too many fine people fall at the hands of this group. There are always going to be loop holes. But once again, I hope you are right. I want you to be right!

I fear the court's next step will be NOT to drop this but continue their obvious retaliation towards Duty with proceeding with getting her disbarred. If this happens and I pray that it does not, they will then appoint a "family" member to take over until election time. It's an ugly cycle.
